These terms govern your use of beatspark and beatspark.com during the closed-beta phase. By joining the waitlist, downloading beatspark, or running it, you agree to them. If you don't agree, don't sign up.

1. Beta status & warranty disclaimer

beatspark is pre-release software. It may have bugs, change substantially between versions, or be discontinued.

beatspark is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

beatspark is not affiliated with, endorsed by, or sponsored by Ableton AG. "Ableton Live" is a trademark of Ableton AG.

2. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. Our aggregate liability for any claim is limited to the fees you paid us in the 12 months preceding the claim.

Nothing here limits non-waivable rights you have under consumer-protection law (e.g. Oregon's UTPA, ORS 646.605 et seq.).

3. What you can and can't do

You may install and use beatspark on machines you own or control, for any purpose including commercial production. You may not:

Anything you produce with beatspark is yours. We don't claim ownership of your Ableton projects, audio, or MIDI. We may use anonymized telemetry to improve the product (Privacy Policy for details).

5. Account & termination

Your account uses email + magic-link OTP — keep your inbox secure. You can delete your account at any time by emailing privacy@beatspark.com. We can revoke beta access if you violate these terms or if we wind down the beta.

6. Changes

Material changes bump the "Last updated" date above. Continued use after a change is acceptance.

7. Governing law & contact

These terms are governed by Oregon law, without regard to conflict-of-law principles. Disputes go to the state or federal courts located in Oregon. This does not deprive you of mandatory consumer protections under the law of the place where you live.
